Agreement to Terms

By accessing or using the services of MapleLane Fitchburg Concrete, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services or website. These terms apply to all visitors, users, and others who access or use our services.

Services Provided

MapleLane Fitchburg Concrete provides residential and commercial concrete services including but not limited to driveways, patios, foundations, decorative concrete, repairs, and related services. All services are subject to availability and our acceptance of your project.

We reserve the right to refuse service to anyone for any reason at any time. All project quotes are valid for 30 days from the date of issue unless otherwise specified.

Quotes and Pricing

All quotes are estimates based on the information provided at the time of inspection. Final pricing may vary if site conditions differ from initial assessment or if you request changes to the project scope. We will communicate any pricing changes to you before proceeding with work.

Quotes do not include costs related to unexpected subsurface conditions, utility location services, permit fees, or other items not specifically mentioned in the written quote.

Payment Terms

Payment terms will be specified in your project contract. Typically, we require a deposit before work begins, with the balance due upon completion. We accept payment by check, cash, or electronic transfer as specified in your contract.

Late payments may be subject to interest charges as permitted by law. If payment is not received according to the agreed schedule, we reserve the right to suspend work until payment is brought current.

Project Timeline and Scheduling

We will provide an estimated timeline for your project. However, actual completion dates may vary due to weather conditions, material availability, permit delays, or other factors beyond our control. We are not liable for delays caused by circumstances outside our reasonable control.

You agree to provide clear access to the work site and to keep the area free of vehicles, equipment, and other obstructions during the scheduled work period.

Changes to Project Scope

Any changes to the agreed project scope must be requested in writing and will require a revised quote. Additional work or materials requested after the project has begun may result in adjusted pricing and timeline. We will not proceed with scope changes until you have approved the revised terms.

Warranties and Guarantees

We stand behind the quality of our workmanship. Specific warranty terms will be provided in your project contract. Our warranty covers defects in workmanship but does not cover damage caused by improper use, lack of maintenance, ground settling, freeze-thaw cycles beyond normal expectations, or acts of nature.

To maintain your warranty, you must follow all maintenance recommendations provided at project completion. Warranty claims must be submitted in writing and will be evaluated on a case-by-case basis.

Property Access and Safety

By hiring our services, you grant us and our crew access to your property for the duration of the project. We will make reasonable efforts to protect your property and landscaping during work, but some temporary disruption is normal for concrete projects.

You are responsible for securing pets and ensuring that children are kept at a safe distance from the work area. Our crew follows safety protocols, but active construction sites present inherent risks.

Liability and Insurance

MapleLane Fitchburg Concrete carries general liability insurance and workers' compensation coverage. However, we are not liable for damage to underground utilities that are not properly marked, pre-existing property damage, or damage caused by factors beyond our control.

You agree to have all underground utilities marked before work begins. This is typically done by calling 811 at least 72 hours before the project start date.

Cancellation Policy

If you need to cancel or postpone your project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may result in forfeiture of your deposit to cover materials ordered and scheduling costs. Cancellations after work has begun will be charged for all work completed and materials used.

Dispute Resolution

If any dispute arises regarding our services, we encourage you to contact us directly so we can work toward a resolution. If we cannot resolve the matter informally, you agree to submit the dispute to binding arbitration in accordance with Massachusetts law before pursuing legal action.

Limitation of Liability

To the fullest extent permitted by law, our total liability for any claims arising from our services shall not exceed the total amount you paid for the specific project in question. We are not liable for indirect, consequential, or punitive damages.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the revised terms.
